Contribución a un marco normativo que regule la actividad del cabildeo ante las instituciones públicas : análisis del proyecto de Ley número 97 de 2016

Abstract

Este trabajo tiene el alcance de aportar a la fundamentación jurídica que contribuya a la elaboración de un marco normativo que regule el ejercicio del cabildeo en Colombia. Asimismo, se realiza una examinación crítica del proyecto legislativo para la regulación del cabildeo, que actualmente se encuentra en curso; y, de manera complementaria, se referencian modelos existentes del cabildeo en el marco del derecho comparado, a fin de contribuir a la pertinencia de la reglamentación sobre la materia reconociendo el contexto del ordenamiento jurídico interno. La tesis propuesta que orienta esta investigación está asociada a la necesidad de contar con un marco normativo que regule el ejercicio del cabildeo, a fin de garantizar la seguridad jurídica y la transparencia de las relaciones entre los particulares y el Estado, que permita canalizar los distintos intereses mediante procesos institucionales, en el marco del derecho a la participación y el interés general...

This work has the objective of increasing the scope of the fundamental jurisdiction which contributes to the regulatory framework that manages the practice of lobbying in Colombia. Likewise, this makes the critical examination of the legislative project towards regulation of lobbying, which at present is found occurring; and, in a complementary fashion, references existing models of lobbying in the framework of corporate law, for the purpose of contributing to the relevance of the regulation about the matter recognizing the context of the internal legal system.
