El lenguaje del poder y el poder del lenguaje: literatura en las sentencias de la Corte Constitucional Colombiana

Abstract

En esta tesis se desarrolla un análisis retórico y jurídico del uso de citas literarias en las sentencias de la Corte Constitucional colombiana de 1991 a 2017. Este fenómeno se estudia a partir de los tres autores más citados por esta Corte: George Orwell, William Shakespeare y Sófocles. Se estudian las razones por las que los jueces acuden a la literatura y a estos autores en específico para argumentar sus decisiones, el efecto persuasivo que tiene la literatura como argumento dentro de una sentencia y la forma en que estas citas literarias impactan el sistema de fuentes del derecho.

In this thesis a retorical and judicial analysis is developed regarding the use of literary sources in the sentence/trials of the Colombian constitutional court of 1991 to 2017. This phenomena is studied based on the three most cited authors by this court: George Orwell, William Shakespeare and Sofocles. The reasons why the judges use these authors and their literature to reach their decisions and support their decisión, as well as the persuasive effects their literature has in an argument within a sentence, and the form in which these literary citations impact the law system are studied.
