Poder constituyente en el orden nacional y transnacional

Abstract

Este trabajo saca a la luz las tensiones y contradicciones entre los conceptos de poder constituyente y de soberanía popular en las postrimerías del siglo XVIII. Así se muestra que no resulta atinado el entrelazamiento histórico/conceptual que establecen importantes autores. En realidad históricamente la soberanía popular ha sido un concepto incómodo para el constitucionalismo, en virtud de sus connotaciones absolutistas. En cambio el poder constituyente surgió ligado con el principio de división de poderes y el gobierno representativo. En los últimos años se reactivado la discusión sobre el poder constituyente, no sólo en torno a un conjunto de categorías que conforman lo que denomino ?gramática constituyente?, sino también sobre la plausibilidad de trasponerlo al contexto transnacional con el objetivo de transnacionalizar la democracia a nivel de la política constitucional.

This work brings to light the tensions and contradictions between the concepts of constituent power and popular sovereignty at the end of the 18th century. This shows that the historical/conceptual intertwining established by important authors is not correct. In reality, popular sovereignty has historically been an uncomfortable concept for constitutionalism, by virtue of its absolutist connotations. On the other hand, constituent power arose linked to the principle of division of powers and representative government. In recent years the discussion on constituent power has been reactivated, not only around a set of categories that make up what I call "constituent grammar", but also about the plausibility of transposing it to the transnational context with the objective of transnationalising democracy at the level of constitutional politics.
