El sistema de cuadrícula minera como la nueva regla geográfica para el otorgamiento de títulos mineros en Colombia

Abstract

Colombia, debido a su estratégica ubicación geográfica, es un país que cuenta con un gran potencial para el aprovechamiento de recursos naturales no renovables y, de suyo, para el desarrollo de proyectos mineros como vehículos de progreso para el país y las regiones. Precisamente, en virtud de ello, se hizo necesario para el Gobierno nacional establecer un marco normativo, institucional y tecnológico que le permitiera adelantar la eficiente administración de dichos recursos. Así, el foco del presente trabajo será exponer y comprender, bajo una metodología de análisis legal y normativo, cuáles han sido las modificaciones y acciones estatales que paulatinamente se han ido generando para estandarizar, bajo el sistema de cuadrícula minera, la forma en que se selecciona y delimita un polígono para el desarrollo de un proyecto minero en Colombia y su ámbito de aplicación. Para ello, y teniendo en cuenta las particularidades del sector minero, se adelantará un análisis de los sustentos legales del sistema de cuadrícula y se definirá, posteriormente, cuál es su ámbito de aplicación. Ello, mediante la preparación de un concepto jurídico que, de manera clara y concreta, otorgue claridad legal sobre la materia y sustente su aplicación a todas las propuestas en trámite.

Colombia, due to its strategic geographical location, is a country that has great potential for the use of non-renewable natural resources and, in itself, for the development of mining projects as vehicles of progress for the country and the regions. Precisely, by virtue of this, it became necessary for the national government to establish a regulatory, institutional and technological framework that would allow it to advance the efficient administration of said resources. Thus, the focus of this work will be to expose and understand, under a methodology of legal and regulatory analysis, the results have been the modifications and state actions that have gradually been generated to standardize, under the mining grid system, the way in which selects and delimits a polygon for the development of a mining project in Colombia and its scope of application. To do this, and taking into account the particularities of the mining sector, an analysis of the legal bases of the grid system will be carried out and its scope of application will be defined later. This, through the preparation of a legal concept that, in a clear and concrete way, provides legal clarity on the matter and supports its application to all the proposals in process
