Esta investigación trata sobre la manera en que la Corte Constitucional resignificó la subjetividad individual de los recicladores que habitaban en los márgenes del antiguo basurero de Navarro, en la ciudad de Cali. El artículo ubica este gesto en el marco de las técnicas de gubernamentalidad que se producen a partir del régimen neoliberal, e identifica cómo, a través de la manipulación del deseo en un plano discursivo, la Corte construye un nuevo sujeto: el ¿empresario de la basura¿. Igualmente, a partir de la voz de los diferentes actores de la problemática tratada, la investigación explora los efectos que aquella transformación tuvo sobre la forma en que las entidades públicas involucradas trataron a los recicladores y sobre cómo se vieron afectadas las aspiraciones de estos, en un plano real. Para desarrollar esta temática, el artículo se divide en dos partes principales: (i) un marco teórico que explora la genealogía del discurso neoliberal y la construcción de una específica subjetividad en su seno, a partir del deseo, y (ii) un análisis de la problemática de los recicladores del basurero de Navarro, a partir de las consideraciones de la sentencia T-291 de 2009 y del marco teórico esbozado previamente. El trabajo no pretende evidenciar la posibilidad de aplicar el marco teórico a la realidad de manera mecánica, sino que busca utilizarlo como una suerte de lente, para hacer inteligible dicha realidad de una manera determinada. Por último, la investigación plantea situarse en el marco de una discusión mucho más amplia, sobre cómo el neoliberalismo ha afectado diversas subjetivades de manera heterogénea a la lo largo y ancho de la diversa sociedad colombiana.

This research deals with the way in which the Constitutional Court resignified the individual subjectivity of the recyclers who lived on the margins of the old Navarro garbage dump, in the city of Cali. The article places this gesture within the framework of governmentality techniques that are produced from neoliberal thought, and tries to identify how, through the manipulation of desire on a discursive plane, the Court constructs a new subject: the ¿trash entrepreneur". Likewise, based on the voice of the different actors of the problem addressed, the research explores the effects that this transformation had on the way in which the public entities involved treated recyclers and on how their aspirations were affected, in a real plane. To develop this theme, the article is divided into two main parts: (i) a theoretical framework that explores the genealogy of neoliberal discourse and the construction of a specific subjectivity within it, based on desire, and (ii) an analysis of the problem of the recyclers of the Navarro garbage dump, based on the considerations of the ruling T-291 of 2009 and the theoretical framework outlined previously. The work does not pretend to show the possibility of applying the theoretical framework to reality mechanically, but rather seeks to use it as a kind of lens, to make said reality intelligible in a certain way. Finally, the research proposes to place itself in the framework of a much broader discussion about how neoliberalism has affected various subjectivities in a heterogeneous way throughout the diverse Colombian society.
